Commercial Law – Franchising

Whilst franchising is essentially a matter of Contract Law, there are significant statutory regulations of the franchising industry principally through the Trade Practices Act (Commonwealth).

The law in this area is continuing to develop and any franchisor must give careful consideration to the terms of any franchise Agreement, advising documentation and overall issues of fairness.

There are regulatory bodies of which franchisors may become a member and Neumann & Turnour Lawyers can advise on appropriate procedures for establishing a franchise in Australia.

We have experience not only in advising franchisees or franchisors but also in working with franchisors from other countries. This includes undertaking demographic studies and retaining appropriate marketing personnel to identify and recruit franchisees.
