In the seminar Mark Fowler will focus on aspects of commercial and property law that are unique to the not-for-profit and community sectors, including:

  1. The legal process of property ownership and leasing, due diligence and associated tips and traps;
  2. Property holding and associated charitable tax exemptions (including land tax and duty and exploring GST options);
  3. Getting the vehicle right – structuring  of the property holding entity and alternatives in light of charitable status;
  4. Funding contract review and aligning funding contracts with lease commitments.

ACNC Options Paper

The Australian Charities and Not-for-profits Commission (Repeal) (No.1) Bill 2014 was introduced into the House of Representatives on 19 March 2014. The Regulatory Impact Statement that accompanied the first Bill stated that, ‘views will be explored during the second stage of the process and implementation options will give consideration to the impacts on different groups’.

Accordingly, the Department of Social Services (DSS) has released an Options Paper setting out proposed replacement arrangements for charities in Australia and seeking feedback from charities and interested parties.

Written submissions, utilising the DSS submission template, will be accepted until 20 August 2014.

 Civil Society National Centre for Excellence

The consultation project for the design of the Civil Society National Centre for Excellence has reached the half way mark and the second round of consultation has now commenced.

  • The Draft Models Report has been published on the project website.
  • The Phase 2 Online Survey is NOW OPEN.
  • REGISTER NOW for Phase 2 Engagement Workshops. Workshops are being conducted in Perth, Melbourne, Brisbane and Sydney.
